ICE HOCKEY EVENT – SPECTATOR RISK WARNING, WAIVER AND CONDITIONS OF ENTRY (TASMANIA)
By purchasing, accepting, using or presenting this ticket, or by entering or remaining at the Venue, the holder agrees to these terms.
WARNING
Ice hockey is a fast and dangerous sport. Spectators may be injured by flying pucks, sticks, stick fragments, equipment, debris, shattered or displaced glass, and by players colliding with boards, glass, gates or barriers. Serious injury or death may occur.
Acknowledgment of risk
The ticket holder acknowledges that attendance at this Event and presence at the Venue involves obvious and inherent risks, including risk of personal injury, permanent disability and death.
Those risks include, without limitation:
(a) pucks leaving the playing surface at high speed;
(b) sticks, stick fragments, equipment or other objects entering spectator areas;
(c) players crashing or colliding into boards, glass, gates or barriers near spectators;
(d) glass, boards, gates, barriers or safety infrastructure cracking, shifting, failing or causing debris to enter spectator areas;
(e) slips, trips and falls in seating areas, stairs, concourses, aisles and entry areas; and
(f) acts or omissions of players, officials, venue staff, contractors or other spectators.
The ticket holder acknowledges that netting, glass and other protective measures reduce risk but do not eliminate it.
Assumption of risk
To the maximum extent permitted by law, the ticket holder voluntarily accepts and assumes all risks associated with entering, attending or remaining at the Event or Venue, including the risks described above.
Conditions of entry
Entry is conditional on the ticket holder:
(a) remaining alert to play and activity around the rink at all times;
(b) complying with all signs, warnings and directions of venue staff, security and the Organiser;
(c) remaining within authorised spectator areas unless expressly permitted otherwise;
(d) not interfering with safety netting, glass, boards, gates or barriers; and
(e) properly supervising any child or dependent person accompanying them.
Any person who does not comply may be refused entry or removed from the Venue without refund, to the extent permitted by law.
No exclusion of non-excludable rights
Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified.
ACL wording
If, and only to the extent permitted by law, and if the services supplied in connection with admission to the Event are properly characterised as recreational services for the purposes of section 139A of the Competition and Consumer Act 2010 (Cth), liability for death or personal injury arising from breach of a consumer guarantee applicable to those services is excluded to the maximum extent permitted by law. This clause does not apply where liability cannot lawfully be excluded.
Minors
If the ticket holder is under 18 years of age, these terms operate as a risk warning and condition of entry. The accompanying parent or guardian accepts responsibility for supervising the minor while at the Venue.
Release
To the maximum extent permitted by law, the ticket holder releases and discharges the Organiser, venue owner and operator, participating clubs and teams, league and governing bodies, and their respective officers, employees, contractors, volunteers and agents from all claims, demands, actions, losses, liabilities, costs and expenses arising from or in connection with personal injury, death or other harm suffered by the holder at or in connection with the Event or Venue, where such harm arises from or is connected with the risks referred to in this document.
Governing law
These terms are governed by the law of Tasmania.
